FAQs
I have been in a wreck and it is not my fault. What insurance should I use?
If you have been in a wreck, the first insurance you should look to is med pay under your policy if you have coverage available. If you don’t have med pay, or if your med pay has been exhausted, and you have health insurance, use your health insurance.
If the wreck was not my fault, why should I use my insurance?
Often times, the average person is not aware of how the claims process works, or that you can even use your own insurance in an accident. The reason you want to use your insurance, regardless of fault, is because your bills will get paid in a timely manner and you may be entitled to a pay down under your policy. Settling your claim with the at-fault insurance company can be a lengthy process. Many medical providers do not want to wait for payment, and the added financial burden of these medical expenses can be crippling to your household finances. Utilizing med pay and health insurance initially provides you with some help covering these losses while you are working toward a settlement with the at-fault insurance carrier.
Additionally, the pay down you receive is beneficial to help you keep the most money in your pocket. For example: If you have medical bills that total $10,000.00 and your health insurance company gets a contractual pay down only paying $5,000.00, you can still make a claim for the full amount of your medical expenses with the at-fault carrier. This means you get the benefit of the entire bill for settlement purposes while only owing the provider the contractually agreed amount. This results in you keeping more money in your pocket.
Further, Arkansas recognizes the “Made Whole Doctrine.” Under that doctrine, there is a likelihood that we would not have to reimburse your insurance for the payments made on your behalf. Navigating through claim settlement and dealing with insurance companies can be tricky. Hiring a legal professional that can help you navigate this difficult time is advised. Don’t leave money on the table.
